Terms of Service

These Terms of Service (“Terms”) govern access to and use of SinoFlare websites, consoles, APIs, and related services (the “Services”) operated by SinoFlare (“we”, “us”, or “our”). By creating an account, signing in, or using the Services, you agree to these Terms.

1. Eligibility

You must be able to form a binding contract and must provide accurate account information. You are responsible for safeguarding your credentials and for all activity under your account.

2. Accounts and access

We may suspend or terminate accounts that violate these Terms, applicable law, or our Acceptable Use policies, or that present security, abuse, or payment risk. Features may change, and some Services may be region-restricted.

3. Orders, credits, and payments

Prepaid balances, CDKs, and paid plans are generally non-refundable except where required by law or expressly stated otherwise. Prices, fees (including payment-channel fees), quotas, and validity periods are shown at checkout or in the console. You authorize us and our payment providers to process amounts you confirm.

4. Acceptable use

You must not misuse the Services, including by attempting unauthorized access, interfering with other users, distributing malware, abusing support channels, or violating third-party rights. Additional product-specific rules (including the LLM Acceptable Use Agreement) apply where relevant and are incorporated by reference.

5. Intellectual property

The Services, branding, and documentation remain our property or that of our licensors. You retain rights to your lawful content, and you grant us a limited license to host and process it as needed to provide the Services.

6. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SINOFLARE AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE THREE (3) MONTHS BEFORE THE CLAIM.

8. Indemnity

You will indemnify and hold us harmless from claims arising out of your content, your use of the Services, or your breach of these Terms.

9. Changes

We may update these Terms by posting a revised version. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Services and close your account.
